That hat is actually trademarked by Devo, I believe. I think they've attempted to sue over the use of it before.

Edit: Actually, according the the Wiki it seems like they initially lifted the design from a comic. Either way, I'd look into this further, because I do recall Devo considering suing McDonalds over the use of the Energy Dome hat on a toy that they produced.
