I really like the style...but it doesn't work. Both sides would have to deliberately NOT take the win/block in order to get this configuration, no matter who went first.

No, I agree. There are better ways to illustrate a tie/lose in tic-tac-toe then deliberately losing.

With the two pumpkins though that might not work. Since the last panel is sort of centered around the fact that pumpkin #2 turned into a were-pumpkin and killed his friend.

This is the trick I used to use all the time to win. Candy corn just legitimately outsmarted the pumpkin.
I will give you the benefit of this one but that is what it looks like at first glance. People aren't going to play that out in their head. All they'll think is: That's weird. They lost on purpose.
