Parody is protected under free speech, but the image itself is not. So if the Hulk was doing something funny - something that would be unlike the Hulk, or whatnot, your rights are protected. In the Mario examples, all of them were in many ways designed to make fun of Mario (or the derby), rather than simply the image of Mario himself. Mario having a nightmare that he's naked in front of all of his enemies is a good example of parody.
