My mother’s no longer with us, but when she passed away she left behind five amazing people. A field medic serving his country, a teacher, a political activist, a librarian, and (of course) myself... we are the people we are today because of our mother. Without her we never would have had courage, humor, integrity, creativity, or a desire to make a change in the world. Without her we would not even be here in the first place. Though she is long gone she will never be forgotten. She lives on in our words, our deeds, our very flesh. This shirt is a tribute to her... recalling the days of joy and laughter when we were a bunch of wild kids who endlessly poked and joked and loved one another dearly, despite the arguments about who got to sit where at the dinner table. This Mother’s Day I would very much like to give this shirt as a gift to each of my siblings, who would look at the playful kittens here and see, I hope, a bit of ourselves and a bit of our mom as well.

If this shirt manages to make it to production, my very first shirt check will be entirely donated to a breast cancer charity. Millions of mothers, sisters, wives and daughters will be stricken by breast cancer. With our support they can survive... with future research they can be cured.

If you’d like to make a donation, Susan G. Komen for the Cure will help you to help mothers everywhere. Even if you can’t donate, please visit their site and get informed. Early detection is a crucial part of surviving breast cancer.

I love this image. I am also one of five children and my mother is battling breast cancer. This is a great shirt and a beautiful way to remember your wonderful mother. You have my vote and best wishes.

Wow... amazing coincidence. I'm very sorry to hear you and your family have to deal with cancer. I'm very glad you like my shirt and I send my healthiest wishes to your mother.

What color would you like to see? I was originally going to do it on pink, but Woot doesn't offer pink. This color provided (to my eyes anyway) the nicest contrast.

I voted for this, because I love the art, but I wish the design wasn't so far down the shirt. When I tuck it in the image will be mostly gone.

Actually, given American Apparrel's shirts, it should be okay for tucking. The kittens will be peeking out over the waistband (if I judge my shirts correctly :-).

Glad you like it. I was going to submit on black... thought more people would buy grey for their moms. Hopefully this'll be dark enough to appeal. :-)

I've donated to several friends who have done the 3-day walk, as I can't do it (health issues). I love the idea of donating the woot check in your mom's honor.

I'm so glad you like it, and your mom would like it. Wow... another family of five? Guess there are more of us around than I had thought.

I'm also glad to get people to spend some time thinking of others. I have no idea whether this shirt will make it to printing but I'd really like the chance to send a big wad of cash out to a cancer charity. Thanks for the good wishes for my mother, I am thrilled to say she is doing much better than I ever hoped for, right now. We have been very fortunate.

As for what color I would like to see, when you consider that you are using the shirt background as part of the color/s of your kittens, the gray seems to be your best choice. I would have loved to have seen this on pink. I've purchased a few gray shirts, lately and am tired of the color but I can't think of anything that would work better, now that I think about it. I will certainly buy this if given the opportunity!

This spring marks my mom's 4th anniversary of being a breast cancer survivor, so I commend you on your donation plan. In addition to being a mother of 4, she's also grandmom to 6 grandkitties, so this is definitely a shirt I love (only 3 of the kitties are mine!). And I'm happy it's not on pink, because I don't think I've worn pink since I was about 4 years old...and don't want to start any time soon. Anyway, it's a fab design!

Congratulations to your mother on four years of survival. The power and effectiveness of treatments these days are truly amazing. With the help of doctors, scientists, charities, and good-hearted people everywhere we are working towards the day when cancer will be completely curable in 100% of cases. The sooner the better, in my mind.

Never forget that wooters will vote for designs for many many many reasons that have nothing to do with quality. Daedalus has done some quality work in his time here, and I'm sympathetic to his loss, but I quite believe his story has given this added momentum it may questionably deserve.

I noticed in your description that you will allow Woot to donate the money earned from this design to Cancer research. I think this a wonderful idea and it just made me think of an idea for Woot. Don't know if they'd be on board, but maybe we could have a derby devoted to a charitable cause(?) They could sell the shirts for $11.00 on the opening day and donate $1.00 from each shirt's sale to the charity of the designer's choice.

That way, 3 charities would benefit with each of the 3 derby winners.

Just a thought....it could work, no?

I think, by and large, most voters at woot don't even look at the comments. The sheer number of votes that people get compared to the (comparatively) small number of people who ever make a peep in the forums suggest that this is so. So If I had to guess where most of the votes are coming from, I would say they see the derby theme this week is motherhood and that they want to buy a kitten shirt for their mom. But it's certainly true that I'm getting votes for other reasons as well.

Some people are just cat people, and buy any shirt with a cat on it. Some people love my art (I've seen the love in past derbies with no story about my mother in sight). Some people, I imagine, just need a gray shirt and saw this one was closest to the fog.

And, yes, I'm sure there are sympathy votes out there too. But I like to think that being sympathetic to another person's pain is a good thing, that it should be encouraged in humanity, especially when the end goal is to provide funding for cancer research, in hopes that nobody else will ever have to lose a mother to this disease. Or a wife. Or a sister. Or a friend.

I realize others might disagree with that, but that's how I see it.

I think Adder mentioned that idea already and I'm totally for that. I'd have no problem whatsoever designing a shirt for a charity and I'd love if Woot made a derby specifically for designs that support a charity. I've got no idea if the powers that be would be interested, but they'd have my support.

Daedalus, I never got to say how wonderful your design tribute to your mom is, and I am positive she would be so proud to share it with the ribbon in your signature. I lost a good friend to breast cancer last year, and I also have friends and relatives who are survivors. Many reasons for the shirt to resonate for me.

I'm saddened that so many people have lost friends and family to cancer, but I'm encouraged by so many stories of cancer survivors that are out there. Once again, I encourage everyone out there to check out the Susan G. Komen link I posted above and consider a small donation. You can make a difference in people's lives directly, you don't even need to buy a shirt with cute kittens on it.

They are awfully cute kittens, though. :-)

This is a perfect shirt.

My mom has five daughters. When we were all kids and still living at home, we took in a stray cat, who later had 5 kittens. As we each claimed a kitten for our own, Dad could not give any of them away for who's kitten would be the one to go? So we kept them all.. and Dad put up with his 5 girls and 5 cats.

(We also each had a parakeet, 5 birds. The only other woot shirt I have is "for the birds" which features 5 birds on a tree.)

Recently the mother cat had to be put to down when her brain tumor got too large.

I am a cancer research scientist and give my support to any form of cancer awareness.

Actually, I think there are a ton of cat lovers out there. Especially kitten lovers. Given the popularity of lolcats around here, I figured a cute kitten shirt would be a big hit. I realized not everyone is into cats, but since it's a mother derby I'm sure people out there who are indifferent about cats would be looking for kitty shirts for their moms for Mother's Day.

Thanks for the luck... looks like I'll need it. With so many popular shirts out there it'll be hard to hang on to a fog placing until closing time...

This happened to me too. Still happens when I use Mozilla's SeaMonkey. But, it doesn't happen with Explorer or Mozilla's Firefox. It has to be a change in my settings, but I can't figure it out.

Happens when I use Seamonkey to view Bountee too.

I was about to say that it didn't happen to me, but then it did while using Safari and it continued when I switched to Firefox (woot tends to crash my firefox)

Sympathy. This shirt would not be in the fog without the story attached and the niceness of donating the proceeds to charity. On the one hand that's very noble, but on the other a really great shirt like Edgar's might not get printed because of it. I think this design (alone and without the story) is undeserving and will probably open the floodgates of people fishing for sympathy votes. Designwise all this shirt needs is some puffy paint and a little bedazzling to make it complete. I don't think being purveyors of cutesy cat shirts was what woot had in mind, but that's the derby for you.

Wow... a bunch of criticism now. Some of it pretty nasty too. That’s okay, though. Each person is entitled to her or his own opinion. I guess I ought to address some of the ideas there.

No, I’m not fishing for sympathy votes here. My goal was actually to raise awareness for a really worthy cause. I’m sure it’s pretty clear that I could have gone completely maudlin here... made up a shirt design with a grave or something on it and said “I can’t participate in a mommy derby ‘cause my mommy is dead... please vote for me to make me less sad!” That would have been horrible and a poor way to commemorate my mother. I went completely the opposite direction. I made a shirt with an image of a family of cats that I thought would be appealing to people who were looking for something to buy as a Mother’s Day gift. I think I hit that demographic pretty well, given the comments I’ve heard about how perfect a shirt it would be for someone’s mother, grandmother, aunt, sister or daughter. I realize that it’s not the style of shirt many of you would buy for yourself, but I’m pretty sure it’s something lots of people would buy for their mothers.

I can understand why some of you might be upset at seeing my shirt do well. I certainly have seen many shirt designs that I liked get buried beneath other, seemingly less deserving shirt designs. I’ve even seen shirts get what I felt might be an unfair advantage in some way. It can be really frustrating, I know.

Simply telling an appealing story doesn’t get you a pile of votes, though. I send out a story with just about every shirt design I do and I’ve got plenty of designs that just tanked despite my storytelling. I’m just a storytelling kind of person, I guess. I like others to hear the ideas rattling around in my brain when I make a design, so I’ll keep on doing that despite the fact that it’s not a particularly vote-raising strategy. Likewise, promising to donate your profits to charity isn’t a ticket to fog-town either. The last derby I offered to donate to a worthy cause and got less than a hundred votes all told. Less than seventy even. I’m sure there are people out there who see that my entry did well and will try to copy my “formula,” but they’ll be sorely disappointed by the results.

To make it to printing at Woot you have to create something that appeals to a constantly shifting and sometimes maddeningly unpredictable voting base. Some days it’ll be skulls and ravens, other days it’ll be video games or science references... we’ve seen cute shirts, beautiful shirts, dark shirts... nobody can get exactly the shirt designs they want out of every derby. I realize that my design won’t appeal to each and every one of you out there. There are a huge amount of people, though, who are looking for exactly this kind of shirt to use as a Mother’s Day gift... or as a gift for an aunt, a sister, a grandmother, a cat lover... I hope you don’t begrudge them the chance to get their shirt made. They really want to get this shirt printed, and it’s not like I’ll be lining my own pockets with the profits. It’s going to a really good cause and just might help save the life of someone close to you someday. I hope that you get the shirts you want for the next derby. Heck, I’ll even take requests for designs if you like.

i've been designing shirts for a lot of years and it never ceases to amaze me what people like and don't like. I've had designs that i thought were really good that have tanked and ones I thought were poop on toast that sold really well. all you can do is keep plugging. throw enough darts and you're eventually going to hit the bull's eye. you can't blame your design's unpopularity on another design's popularity, because there's no way to predict what's going to strike a chord with the masses.

i'll stop here otherwise i could rant all night about this subject, but to sum up my point in the wise words of my mother "if you can't say something nice, don't say anything at all."

Very well said. I am very impressed with your ability to deal with criticism and negative comments without getting rude.

I love your storytelling with each entry. I'm a writer, and I think about the story for everything. It's great to know what the designer was thinking about when they envisioned their entry, and how the design came into his or her head. While I will happily vote for a cool design, I will "encourage" other family members to vote for a cool design that has a good story behind it as well.

I'm crossing my fingers that some of the shirts I voted for will place this weekend. Maybe it's living as a mom, with my own mom and grandmothers nearby, but this derby was a good one for me as a voter!

I have noticed that people who follow that tripe rarely have anything of worth to say. I prefer "If you can't say something honest..." it gives people something worth hearing, good or bad.

I agree (!) I think the sad story is making people shy away from giving honest opinions about this design. Like how most people hate designs in that location, but it was barely mentioned if at all. No one even bothered to ask where the original image came from, but it could have been traced from a copyrighted source. Who knows? It's unfair to other entries that don't have a sad story with them that are fair game.

Sorry... I was busy elsewhere. I thought it was pretty obvious that I drew it. It's not live traced or anything like that. I looked at some photos of kittens while drawing... even measured them for proportions... does that offend?

Glad to hear it. I think most of the Wooting public never even reads the stories, or even reads the boards at all. It's an art competition and people just go for the art they want on a shirt.

Wha? I didn't say I drew from one image... I said I used some photos as a reference when drawing. I didn't even collage the images together and call it a new image, I made my own drawing. Please stop trying to insinuate things, thanks. It's one thing to not like a shirt, but you seem to be intentionally trying to get me to be angry with you for some reason.

Look I think this whole thing is getting a little ridiculous. I'm very sorry for you and your family and believe your story is true. I didn't like the design and thought it was only fair that someone comment on it since it seemed to be getting a free pass. But I also know where these cats came from, I was hoping you'd come out and say it yourself, but your design is simply two copyrighted Corbis images put together. As far as I can tell, you didn't do anything unique to them other than add a tail to the mom cat. They look pretty much just like they did in the pictures. If it has made a difference for people then that is a good thing, but I don't think you personally have done anything other than put someone elses photos on a shirt and try to make people feel sympathy for you to get votes. the kitties actually do look like a mirror image (facing the other direction) of this photo with different markings... dunno...

this cat was on the same results page, kinda resembles mom sans tail (again facing the other direction w/ different coloration), but not as clear of a connection as the kittens... dunno...

Uhm, no. This is clearly a drawing and not "their photos." A drawing, I might add, that is not a line by line trace of any photo or number of photos. Yes, I used photos as reference for this image. I said so above. Creating a drawing using the poses of cats from an image is not the same as using that image. Artists use the poses that other artists have used all the time. It's not copyright infringement. I didn't just cut and paste their exact images onto a shirt, as you seem to want to lead people to believe. The markings, the fur stylings, all the fiddly little details are my own.

No one is saying you didn't draw it, the point is this is essentially the exact same image as the originals with no unique content from you (I think this is the mother cat). Maybe you just didn't know that many designs have gotten rejected for this. I think someone once did ceiling cat in a new style and it still got rejected.

The composition is unique. The markings are unique. The fur edges are unique. The colorations are unique. Just copying the poses is not copying the image as a whole. Overlay the two mother cat images and I'm sure you'll see how different they actually are, just as the kittens themselves are different.

So why wasn't this disclosed for everyone to see for themselves in the first place? If it doesn't bother you, it shouldn't bother anyone else...you were even asked specifically if it was drawn freehand, you claimed it was referenced and danced around the issue of tracing, and the *.gif shows that we can't believe that. The kittens are lifted directly from the photograph, and changing minor details doesn't change the initial fact. Will you go to the original photographer and ask them if it is okay for twenty thousand dollars or more to exchange hands based solely on work that would not exist without theirs (for future reference - it's highly unlikely that they walked into a fully setup studio, kittens posing perfectly, clicked a button on the camera and walked out, if you happen to not like photography as some people do)? There's a reason there is pricing on the site that you used.

There are others that have been designed by looking at a piece (I hate bringing up spryte again as an example, but it was a huge point of contention during the Trompe L'Oeil derby) and it wasn't too sure if they took the piece directly or if it was drawn from scratch and then modified to look like it but her Coeur de la Mer was allowed to stay. HOWEVER, it was not in the fog at any point. So I don't know if the rules will be more stringent in those circumstances.

And the Ceiling Cat *ahem* Chest Cat was rejected more because there was a shirt similar to it on the internet already. Just wait and see what Joel does. He still has over 24 hrs to change his mind.

This is most certainly not a live trace. Here's what a live trace of that image would look like:



I don't have the settings quite right because I haven't played around with that tool, but as you can see the contours of the original design are different than the contours in my shirt image. I absolutely did not copy every element of that picture. You should clearly be able to see how different they are just by looking at the markings alone, not to mention the fur outlines.

I really hope that resolves this for everyone, though I have a feeling I will keep on being attacked anyway. I'm going to be away this afternoon and most of the evening. I really don't want to come back home tonight to find that I've dropped out of the fog because I wasn't able to defend myself against claims made against me at those times. I hope that these attacks are not a majority viewpoint here and I trust in Woot to make a fair judgment here.

I think they will make a fair judgment. The fact that someone showed that you put copyrighted images on a shirt without making major changes to them is not an attack either. People do the exact same thing and get rejected for it all the time, it shouldn't come as surprise. The 1% of changes to the overall image isn't nearly enough to justify allowing the shirt to continue in the derby. Over half the markings on the cats stayed exactly the same. Almost every line is identical and in the same place. The most major change you made was flipping them horizontally. The issue is of copyright not of tracing. This design is an obvious copyright problem.

When someone accuses my design of being 99% similar to a copyrighted work, that feels to me like an attack. Perhaps you don't see it that way, but please understand my perspective.

I think we've both fully made our cases here. Your claim is that the works are too similar, that the lines are nearly exactly the same and thus this shirt should be rejected due to copyright infringement.

My claim is that the lines are not nearly exactly the same. That the original design and my own are significantly different and that it does not constitute copyright violation.

I think we've both agreed to let Woot be the arbiter here. They have my large size image and now have the other images as well. Let's let Woot compare the two and decide just how similar they are. I'd like to let the matter rest on that point, unless you have anything to add to my above assessment of our differing points of view? Let's leave it up to Woot and we will see by the end of the derby which one of us Woot agreed with. Do you agree to leave it at that?

I understand where you're coming from re: live tracing vs. what you've done... as I said before, it's clear you drew the cats, to me, and it's certainly not a live-trace, but the issue is that whatever method you used to draw them, the end result is far too similar to the original. Woot has rejected more for less.

I've said this before, and I suppose I have to say it again, even though J touched on it in the quote... the best way to really cement your design as unique and safe from rejection is to build a design from your head first. Everyone needs references now and then, and that's fine, but there's a difference between looking at pictures to form your idea and having an idea that can be specifically traced to one picture. The problem for you now is that even if you drew it freehand with the pic for reference, you've added an element of question to your future, as well as your past. As a good artist, one who could definitely pump out a winning design without a heavy aid (look at Canada, after all) it's something that could haunt you more than a crappy one, and it's something I'd definitely suggest combating as soon as possible with your future work. I hate to see that happen to someone who, thusfar, has come across as one of the nicer guys 'round the wooterverse.

What's done is done, man. New theme tomorrow. Make it original and make it count. There's nothing that infuriates a detective like not being able to find evidence. Don't give 'em the pleasure.

For the first time i think ever, I agree 10000% with Adder... i know this wasnt live traced and know it required work. but its a fine line to draw when dealing with anothers photos. And altho most of us dont have 5 kittens layin around, you need to get you reference from either your own stash, an untracable source, or change the image enough to the point where its unrecognizable... but anyway just keep it moving tomorrow your yesterdays news and somethin else will grab our attention... i know i been there... the wooters can gang up on you quick but they can also be pretty forgiving. sometimes.

It's unfortunate to lose your design out of the fog. It was on my to buy list. That said, I understand why woot did it and appreciate them being vigilant about the entries. Now if we could just see a little more consistancy in the application of the rules and I'll be happier.

Maybe I'll just donate $10 to Susan Komen instead of buying another shirt this weekend.

I think that is the best solution by far. All of the people who said they would buy this shirt should now donate that same $10 directly to the Susan Komen Foundation.

No one voted because THEY wanted to give money for cancer. They voted because Daedalus would get $1000 which would be donated for them. I'd say at least a quarter of the voters would never have bought, and even more certainly won't donate without getting an adorable shirt out of it. While I'm confident that Daed would have kept his promise and donated the thousand, I'd be shocked if the charity got $100 out of this plan.

As a good artist, one who could definitely pump out a winning design without a heavy aid (look at Canada, after all) it's something that could haunt you more than a crappy one, and it's something I'd definitely suggest combating as soon as possible with your future work. I hate to see that happen to someone who, thusfar, has come across as one of the nicer guys 'round the wooterverse.

What's done is done, man. New theme tomorrow. Make it original and make it count. There's nothing that infuriates a detective like not being able to find evidence. Don't give 'em the pleasure.


Thanks for the advice, Adder. I've clearly misinterpreted what Woot permits and does not (perhaps based on what they let slide in previous entries). I'm certainly going to be a far deal more vigilant in the future. Thanks also for the encouragement.

I'm very touched that people are contemplating doing this kind of thing, still. It's not the outcome I would have originally hoped for, as Adder points out, but I think even in adversity we can do the best we are able. Thanks to everyone who chooses to donate to the Susan Komen foundation. We may not raise a thousand dollars, but they appreciate whatever you can give.

Daedalus, way to keep your neck up and learn from your mistakes/misinterpretations. It's difficult not to get frustrated and discouraged in these situations, but you have handled this well, and I'm sure we will see more top-notch work from you in the coming derbies.
