Agreed. There is no parody in this design, even by the apparently new standard set by "Spicy Italian Meatball".

What copyright infringement? It's just a fuzzy blue spider with huge eyeballs hanging around some cookie crumbs.

Can't be. When I search for "fuzzy blue spider" under google images, I get pictures of a head tattoo, a gray kitten, dewdrops, and Bill Belichick. This picture is clearly none of those.

First if your argument is I typed it in Google and it didn't spit something immediatly back, then thats your own problem. Look up Cobalt Blue Tarantula and tell me what you find. Second bobble eys are not copyrighted (otherwise Geico would be in trouble with there cash stacks, along with about 2000 other characters) neither is blue fuzz, or cookies, or spiders.

Um... where's your comments under number one and two right now in the lead who are totally passing off Van Gough's and Dr, Suess' original styles? At least this one is a tribute to Jim Hensen... or the cobalt blue tarantula- that's hilarious by the way. Learn something new everyday....

Always loved this idea. Hope it survives the rejectionator. I'm going to wear it on those days where I fall off the wagon from my gluten free diet. =)

Re: The Fix

Well this was an experiment and I think it went well. 262 votes in then terminated. The thing is that this isn't really breaking copyright because as I stated before, round eyes like those shown can't be copyrighted due to previous art standards (also his pupils are dilated and uneven in size). The rest of the image can be interpreted in several different ways. I was not showing a mouth or body (which is what the character in question is immediately recognizable by) and the image could very well be a blue spider (cobalt blue tarantula) cartoon image that enjoys cookies.

With the other BLATANT copyright infringing images that have been printed lately though that don't even try to hide what they are I am upset by not surprised.

Please vote for my remaining (original) concepts below and thank you for your support.

Hmmmm...this was cute, but copyright is a weird thing. You don't have to be in violation in order for an alleged infraction to be expensive. It might depend on how likely it is for a company to sue.

Honestly, though, if I ruled Woot (IIRW) I'd probably veto any depiction of characters that anyone recognized. Just because I'm mean that way. And even I knew who this was and I'm generally clueless about kids' programming.

As far as why this was rejected and there are others still standing, it may be a matter of time, or Woot may have decided there's enough parody for them to remain. Or maybe some are so unlikely to print that they aren't too concerned.

Re: The Fix

why is it that this shirt was rejected but the blues clues, smurfs, lemmings, and any blues brothers reference hasn't been rejected???

i don't think this is very fair and it kinda looks like woot is playing favorites again.

One of the Blues Brothers entries was rejected, and the other one has bluebirds in suits, so that's pretty clearly a parody. A reference isn't enough for rejection, Woot has to feel that it's a risk of copyright infringement.

I would suspect that they aren't done rejecting yet, but we won't know until it's over.

The shirt image needs to be a parody. Those other images are parodies... where as this one is not making light of the Cookie Monster. If perhaps the Cookie Monster was injecting himself with Cookie Dough to get his fix... then that would be a parody. (Though, I don't think Woot would print it). It's the same reason why Weird Al can rewrite any song (provided a humorous outcome) without the original artist's approval and make millions performing the songs. Also, it's why Mad TV and SNL do not get in trouble parodying other shows, songs, and movies.

Again this one isn't really making light of the cookie monster, it just incorporates something funny that the cookie monster does.

At least that's what I was able to learn from Entertainment Law.

Just a quick clarification, Al _could_ do parodies without the permission of the original artists, but he never does. He's a class act that way

Don't tell that to Coolio... even though I believe Al's version.
