Re: Fail

Oh they ran into the moon. That makes total sense and is hilarious because it's funny when people run into stuff. The reason this is getting votes is because, like Pavlov's dogs, some people have been trained to laugh whenever the Internets show them a picture with the word Fail on it. Too bad the Fail isn't on the shirt since that's where the votes are coming from, not the dated and weak E.T. joke.

I am sorry to be the one to let you know that you are incorrect.
Perhaps some of the votes that this is achieving is simply due to a pavlovian response to the word 'fail', but I am quite sure that a much greater percentage is based on the quality of the design.

This is a wonderfully drawn piece of work. It will look excellent on a shirt. It is interesting, and funny.

Yes, you are right. A bicycle piloted by a child and an alien will not hit the moon. The fact that you noticed that element of the design is impossible does speak to the excellent education that you have. The moon is really far away. Good job on picking up on that.

Anyhow, this shirt definitely has my vote. Great job!

It would have been funny 20 years ago. Heck it was mildly funny in the endless amount of parodies just like this one that have been done already in movies, cartoons, etc. I'm pretty sure woot had a side deal with a shirt where the kid is falling off the bike. Sorry, not very original, not very funny. "Fail" is doing all the work here.

Re: Fail

I'm just gonna say right now that I didn't even really pay attention to the fail logo at the bottom, I focused on the design of this T-shirt and I think it's pretty cool. Yeah, it's logically impossible to crash into the moon. But when you see ET and that kid after every Universal Studios logo AND the fact that it's one of the highest grossing movies of all time (http://www.cnbc.com/id/31803861?slide=13), I think that this is at least a little more original than flying penguins.

Sourpuss!

This is great. It fun, funny and interesting. It's very well designed and deserves every vote. I guarantee that if fail wasn't in the title, it would still be in the fog, without a doubt in my mind. Besides, if the word fail is your complaint, be mad at the internet, not the designer.

When I opened this link, I nearly spit out my drink when I saw it.
I had to scroll down to notice it actually had a word under it. So no, you are wrong. Sorry to burst your bubble.
A friend showed me the link with a caption reading "Awesome. Vintage work." So I know I am not alone.

In any case, this is a shirt I would buy (WITHOUT Fail on it, I think that is an annoying fad). It's simple, well-executed, and will entertain me after multiple times wearing it. And everyone else will get it.
Congrats.

I never said anything about it being on the shirt being the reason people are voting for it. "Fail" is stamped on the thumbnail and the comp is made out to be like a tired internet meme (woot voters would never be into those would they?). This design would probably get votes without it (Hey, a reference I understand! Vote!) but the idea that this is somehow a hilarious shirt is aided by the fact that half the people here are going to laugh at anything that has Fail anywhere near the title because they are children of the internet and it's so funny!!!

Yep, there's an automatic word filter that changes naughty words. For example, here's Carlin's infamous "Seven Words You Can Never Say on Television":

Manos: The Hands of Fate (1966)
Piss
fire Rocket Number 9
Gypsy
goatroper
Cambot
pick-up sticks

Considering that recent derbies have had non-video game TMNT shirts rejected under the "video game reference" rule, I'd say this qualifies just as much. And not just for the infamous 2600 game, either.

E.T. the Extra-Terrestrial in video games

  • E.T. the Extra-Terrestrial (Atari, 1982)
  • E.T. Phone Home! (Atari 1983)
  • E.T. the Extra-Terrestrial (2001)
  • E.T.: Digital Companion (2001)
  • E.T.: Escape from Planet Earth
  • E.T.: Interplanetary Mission (2002)
  • E.T.: Cosmic Garden (2002)
  • E.T.: Intergalactic Mission (2002)
  • E.T. Away From Home (2002)
  • E.T. Phone Home Adventure (2002)
  • E.T.: Return to the Green Planet (2002)
I think it's a great design (though admittedly a 100% pander to the recent trend of '80s popular culture shirts performing well), but if Woot is going to be even remotely consistent, they would have to reject it for being subject matter that happened to once or twice appear in a video game.

Luckily for radiomode, Woot is almost never consistent when it comes to their rejections.

i do find it ridiculous that the TMNT shirt linked got rejected for being a video game reference. TMNT is a cartoon, not a game. probably does exist some game of it though, but thats really thin. will be interesting to see what the reactions on this shirt are

Actually, it's close to the same design. They've rejected for far less similarity. (Think of it this way... if you saw someone wearing one shirt one day and the other the next, wouldn't they strike you as similar? ET, moon, bike, falling... the only element missing is the crash) And that's a bummer, because this shirt is awesome and funny and I'm considering buying it if it prints, and I haven't said that about anything here in recent memory.

originality is not something RADIOMODE excells at. interestingly enough, its not something SOLDOUTD or TIKITI excell at either. but given "those artists" tendancy to make stock vector collages, im inclined to think at least one of those silhouettes is a stock vector. or maybe that moon is a live trace. or maybe not, who knows. maybe no one ever thought to make stock vectors for these shapes before. but i knew last week when i saw a comment from radiomode that he was back and both his fake accounts were gone for the time being. if anyone is interested, i will post links to threads with some of radiomode most questionable behavior

"Fail" is not doing all the work for this design. I can see where it would definitely help bring in votes, due to the popularity of all the "Fail" pics that are floating out there.
But as someone who watched ET when I was younger, I can also see how the design would appeal to those you loved ET as a child. It's spoofy and cute. I'm not a fan of the whole "Fail" thing, that isn't what makes this shirt design cute for me.
Don't generalize. This design deserves more credit than that. Running into things has been funnier long before the whole "Fail" fad.

This shirt probably draws attention because of the "FAIL" and then when you open it, it looks like one of those demotivational posters. And it would be great for that.

I think it's getting the votes, though, because people love ET. If the ET reference was removed and it was something else crashing into the moon, like a parachuter or an RC airplane, it wouldn't be getting the same number of votes.

So it's probably not just the design, it's the reference as well.

Funny thing is that the ET/bicycle/moon thing was a parody of the witch in the Wizard of Oz. So we've got a parody of a parody of a parody.

It may count as "parody" as far as copyright laws are concerned.

The more I think about it though, the more I think Spielberg himself may have pulled this joke in an episode of Animaniacs or something. I might just be trying to imagine it into existence though, I haven't watched those cartoons in years...

Leahbh how is this not close to the same design? It is the same color pallet and concept (i.e. a twist on the E.T movie poster). Since, both of these designs are based off the movie poster isn't the joke/concept the only portion of the design that is unique? The elements of the movie poster are a given (Elliot, E.T., Bike, Moon) so isn't the joke supposed to be the element of originality. This design is equivalent to the knock off Disney merchandise, and designer purses you see in Tijuana...changed just enough to try to trick the lawyers. This is the Bustedtee shirt with a slight tweak. Radiomode is extremely prolific in the t-shirt design community and I guarantee you that since this design is so strikingly similar to the Bustedtees shirt, he has either seen it or perhaps even designed it under one of his various online handles. My money is on the fact that he aped it. I'd be more inclined to beleive this is a coincidence if there were something dramatically different about the two shirts...

To Radiomode...since it looks like this will print you might want to fix that chunk of missing background swirl/dot pattern above the bicycle. And don't forget to submit your print file on time again.

ET is most likely copyrighted or otherwise protected, but the question is whether Woot thinks this is enough of a parody to be acceptable. And whether or not it's different from other shirts that other people have linked to.

Woot doesn't do a lot of rejecting over the weekend, and they take longer for fogged entries. So just because an entry is still here, it doesn't mean that it's here to stay.

This could be perfectly fine, or not. It's really hard to guess what Woot will do.

sure the Kid is falling

in the Derby shirt, it implies that the Kid crashed into what looks to be the moon, or that the moon was really made of Glass or something that is close and can shatter.
the cape, the Kid, and ET are falling in the derby shirt.

in the Shirt you found off google ET Threw the Kid off the Bike and is flying away in the Light of the moon

both have shared elements but Both are Different Entirely.

should we just point out that there are countless "official" ET shirts that were printed....

The fact that there are countless shirts works against this. For Woot to say "similar shirts exist" they don't need to be identical, they just need to be similar, and the more there are, the less likely Woot is to want to print another shirt with the same theme. Woot has, in the past, rejected shirts with dandelions because they felt there were too many dandelion-themed shirts elsewhere. But none were exactly the same.

I'm not saying that it will or should be rejected. That's up to Woot, and I'm terrible at guessing what they will do. But it's possible that they could decide that ET had been overdone on shirts.

You know, I think swirly halftones look neat, it's just kind of lost its novelty and now I don't really get it. I can see using them to simulate glow, but here I'm not certain what they're meant to add to the design. It's just gratuitous swirly stuff.

See:
http://s3.amazonaws.com/wootdesigncontestentries/922349/7df20a44-0f82-4e76-9670-9995b4257835.jpg
AND

And I know this isn't by him but
http://shirt.woot.com/Derby/Entry.aspx?id=32326

It's all in that same vein. I get it, it's aesthetic, but it's become a bit generic so it's lost that appeal for me. Now it seems a bit gimmicky, and it doesn't fit with the silliness of the shirt. Which... well, as pop culture references go, just ok. The art is well done, and there's not doubt there's skill there, I just don't think the composition is particularly creative or cohesive in how it's presented. Obviously plenty of people like it, though.

how could you not? the only way to see the image is to click on the thumbnail, and the thumbnail displays the word "fail" really close to the joke. so either you have very large blind spots on your eyes, or you are making that up just for the sake of arguing for a design that has no merit other than "it made you laugh". the fact is radiomode felt the need to put the word "fail" on the thumbnail, and someone people think it was a transparant and shallow way to get quick votes. we will never know what difference it made because its already there. but im willing to bet, you slap the word fail on a thumbnail of any of these other designs and its going to get more views, if not more votes.

I don't know, I still have a little bit of an issue with the obvious reference to a copyrighted property, but that's just me. It's a beautiful design and very funny though.

This is a TERRIBLE rejection. Why is that stupid jetpack shirt still not rejected. It's way more similar to already printed shirts than this one is.

And that example that someone else posted as similar is NOT. In that one, ET stole the bike and pushed elliot off, in this one, they both crash into the moon, not similar at all. And as for your similar colors argument, it's a freakin' moon and sky, what other colors were they supposed to use?

You all just don't like this shirt and wanted it rejected. Well, you got your wish, now go tattle on the jetpack shirt.

leaps into the vacuum that this one is rejected. far out the best thing in this derby. not at all like the busted one and originality? good luck finding any.

Throw your toys out of the pram, why don't you?

I don't think people were making a fuss over whether they liked it or not--I didn't see any complaints on the caliber of the design. It was just rule technicalities people took issue with.

Aesthetically I do think it's a shame it got rejected. IMHO it looked great and made me laugh; I would have considered buying it. I can only speak for myself, but my point of contention was the obvious reference to ET, not any similarities to existing shirts. I just feel uneasy about the use of copyrighted properties, and would rather play it safe than sorry.

Leahbh - I "FAIL" to see why you are such an avid defender of Radiomode.

If two t-shirt designs look similar at a passing glance...then they are way too similar. Changing the position/activity of the characters is not enough to create a significant distinction.

The original design is for sale on a well known T-SHIRT site. Do you really think people on a website for t-shirt design aren't going to be aware of current designs in THE SAME MARKET? Budi Kwan participates in a TON of t-shirts competitions and sells to multiple sites. Its incredibly hard to beleive that Budi accidentally created something that looks just like a featured design on another site. A more likely scenario is that he saw the design and figured he could change it just enough to pass for different...I guarantee you the original designer would be pissed.

As for other colors an artist might make the moon? My answer is, any color.

P.S. Don't bother responding with your typical defense, "Its just a t-shirt." We've been over that.

i'm not defending the artist, I'm defending the design. I mostly don't even look at the artists, I vote for shirts I'd buy. But woot needs to use the same rules for everyone. If they reject this, they need to reject the jetpack shirt which has been done on threadless and countless other sites. it's ridiculous. It's stupid and woot s u c k s! I'm getting very close to being done with this site and their "rules". I'm not giving them anymore of my money.

you may be pissed but fact is, this shirt was similar in alot of ways to the other.
Sure the concept was different, but it Had rejection all over it from the start.

which leaps into the vacuum because I loved it.

as for the Jetpack. give it time. it "should" get the boot too I don't see how the rejectionator would miss that one.

It had rejection written all over it from the start? Then why didn't shirt.woot reject it before it became so popular? It's ridiculous allowing everyone to get hyped about it for days THEN rejecting it.

Also, I wouldn't exactly say the shirts are extremely similar to warrant a rejection. ESPECIALLY since that jetpack shirt is still there.

As I was reading the response about woots rejection meetings having beer in them, I was sitting in a terrible meeting (obviously not paying steller attention ) thinking, 'if only this meeting had beer'.
Beer would fix and explain everything. It also would make bad meetings wonderful.

No, because they rejected a shirt with a somewhat similar design when they choose not not reject other shirts that are EVEN more similar to existing designs, like sekiyoku's pumpkin cat or that quick brown fox and lazy dog shirt

It's pretty predictable that woot will almost always disenfranchise a perfectly justified entry and leave a should-have-been-rejected-a-year-ago one up and in the fog all week.

Not that FAIL was justified. I'm kinda in love with the rejectorator when they go heavy handed on the referential rejections. *bats eyes*

To me, it doesn't matter when it's rejected. So long as "when" is "before the derby is over".

You could save yourself the annoyance by telling yourself "every shirt with a licensed character somewhere on it runs the risk of rejection". People would still have been annoyed if it was rejected Saturday.

The end result is still the same whether it's rejected now or earlier. It's just that rejecting it now means he can't slap tiger stripes on it and get it near printing.

WOOT started this shirt thing with the intent on offering shirt that you couldn't get anywhere else. so to reject for similar shirts exist,is the very thing they are looking for. they just hire people that don't know what that is.

similar shirts were proven to exist, though, so...

Look, if you're panties are in a bunch because this is less like said shirt than the rocketpack is to other rocketpacks, I'm with you. Woot is proving why people are so malcontent with them on that move. But it is still a viable rejection made no less viable for what has gone unrejected.

I think this shirt is just as bad as the rocketpack (which has awful physics) in terms of similarity. This one contains silhouettes, the same objects, same color scheme, osv. as the other shirts. At a glance, the referenced shirts could easily look like this one.

The rocketpack is just a bland overused idea that was never appealing in the first place.

I still love this design. It's funny enough that people can see it and get a kick out of it over and over... I don't find too many of those shirts here anymore so I hope this pops up elsewhere.

Of course it uses the same elements it's referencing a famous movie scene!
And this shirt is far more clever than the one that already exists.

This leaps into the vacuum I really wanted to buy this shirt too. Screw all ya'll ivory tower types, this is an awesome shirt.

If the shirt said fail, that wouldn't be incidental text. Incidental is something like the word "Stop" on a stop sign, "#2" on a pencil which appears because it is inherent to the object being illustrated. You can still drow a stop sign or a pencil without any letters and people would still know what they are. The word fail would not be incidental unless it was somehow incorporated into the pattern of the shattering moon or subtly written in the crater pattern, but those ideas would definitelty be stretching the idea of incidental.

Yup, Woot!, you f'd up on this one. I'm a black box level Wooter (100 plus purchases annually) and I won't be making any new purchases with you guys because of this. I stayed up late waiting for ET and, you know what, I WANT ET DAMMIT! Other shirt co's online have done ET and other 'copyrighted' parodies with ZERO repercussions. The only disaster here is the stupidity of rejecting it so late in the game and for all the wrong reasons.

Except ET is not only a copyrighted character, but the shirt concept has technically been done already.

Thank you, though, for underscoring the differences here. You want your shirt to win regardless of what reasons it may have to be rejected, because you think you deserve it. While many of us want good shirts to win regardless of our own desire, because we have a sense of duty to people who take the time to make the most creative and quality shirts possible.
