Guys, I tried to pm the artist about this, but Nyancat is very, very protected at this point. The original owner of the image has filed for copyright/trademark on it, and from what I heard/read, they are actively forcing the removal of all parody of Nyancat. There's some other artists who did Nyan parodies and they were forced to remove their shirts from sales sites.
I love this image, but I dont want anyone in trouble. There's other artists confirming that indeed, the Nyancat owner, as well as the company producing apparel for Nyancat, are not allowing these images for sale.

I've seen quite the opposite of the original artist claiming copyright on this. I've seen him OK everything from shirts to books to 3D prints.
Someone really should get in touch with him rather than assuming there will be copyright issues.

On that note, isn't parody protected under fair use? I don't think they can send cease and desist orders (with any legal backing) on such a thing.

Really, if the artist is pursuing people legally than woot wants to play it safe here.
However, being a long time fan of Weird Al, I've picked up a few things on parody over the years. Weird Al usually contacts the people that he is parodying and asks for permission before doing his humourous take on them. Most say yes, some are jerks and claim they never said yes then take it back when they are found to have no sense of humour, and one (Prince) consistantly turns him down. That being said, parody artists do not need to ask permission to do parody, it is in fact, protected legally.
All that said though, I can understand why woot would reject. If the original artist is really uptight, then even if they have no ground to stand on, why would woot want to entangle itself in a possible legal battle?

Just a month ago, this lawsuit involving a parody design hit Threadless.
Woot has had its share of dealing with lawyers in the past ... and they probably don't need more of that. So as I see it, if there's any doubt involved in such a close parody, rejecting is a safer bet than having to deal with the legal aspects later.

Parody is a defense, not a right. The copyright owner can sue and could win.
