Usually that means that you must release your derivative work under the same license. Anyway, it's still a photo. The rule isn't "only public domain photos, or ones you took yourself", it's "no photos".

Fortunately for me, "photos" were not around during Shakespeare's time so it's not actually a photograph. ;)

You do know that 'photo' is short for 'photograph' and means an image captured by a camera?

Shakespeare was dead long before the camera had been invented. Any image of him is not a photograph. If this image counts for fair use or not is debatable, but really, it is not a photo.

Let me rephrase, it's a photo of someone else's artwork on the web. It was saved on said website as a GIF image, short for Graphics Interchange Format. Either way it is not the original artwork of elinox. geez louise.
