Out of all the many flag entries, this one stands out, partly because the flag is merely suggested by the colors.
Wearable.
On the first "t," I would have ended the cross bar under or even before the "h." That little bit of "t" past the "h" draws the eye too much.
But you still got my vote.

I think this would have looked better on a black shirt (so the brightly colored fireworks really pop) with the silhouette in rich gray/charcoal instead of the other way around. I'd also have thrown in the Gateway Arch in your USA locale symbols for symmetry and balance.

You're thinking about this the wrong way. It isn't about what you're entitled to use and still be within the letter of the rules, it's about what you can create. I think this will most likely be rejected (if they care about that this week) because it looks like you mainly just took the source graphic and filtered it. Still, even if you're not rejected, using recognizable stock may cost you votes. You just can't make a one-of-kind design using a stock graphic as the centerpiece, you know?

All that said, I think it's a clever idea.
