parkermc wrote:First of all, I'm not going to call you mean. You didn't do any rejecting. But you did bolster my point. While melting snowmen may bear a striking resemblance in thematic material, this design had ZERO melting snowmen. It was the anticipation of the event that made this shirt unique. It's easy to show an event. It takes talent to project emotion at an impending event, particularly on snow. The ultimate irony is that the printed snowmen design was publicly called out over a 12 page thread for being an utter rip-off of previously existing work on other sites.
(...)

OK, let's try to look at this even remotely objectively. I'll call them (A) and (B) for the previous and current entry, respectively.

Can we agree that A and B involved snowmen?

Justification: (Surely I don't have to justify this one.)

Can we agree that A and B involve snowmen and their fear of mortality?

Justification:

A - One snowman dying, with a face that screams pain. One snowman hurriedly "running" away to avoid the same death.
B - Three snowmen "standing" around, seeing a flower on the ground, horrified that they now know their time is short and that they will soon perish in a snowman's version of armageddon. One snowman covers her eyes because she can't face the facts, one faints from the stress, and one has a scream of terror on his face concerned with their impending doom. All three snowmen are specifically showing reactions to their mortality and impending doom.

If the two descriptions above are correct, then the two entries are at least largely based on snowmen and their fear of mortality.

Can we really be having an argument that this is not the main subject for both pieces, without delving into the quality of expressions, or a melting snowmen, a sun, a flower, previous controversies, other designs, etc.?

thedansterwashere wrote:My reasoning behind this is to show a dark tree strugling through winter with a dark and somewhat gloomy sky. I wanted windows or boxes (pockets...maybe not the best word choice, sorry) to show the spring equivalent. The tree now the old sky color to show more life. The sky now light blue and bright showing contrast. The birds came later as a fairly random idea. I wanted them to embody the pocket showing spring returning as they returned (which wouldn't let me use box or window in the title). I wish I had added more leaves and blossoms but I just didn't have enough spare time. I also think that it may have subtracted from the fact that the tree continued through the pocket in the exact position.

The definition I imagined for the pocket reference could be explained by the definition from dictionary.com...
7. pock•et - noun - any isolated group, area, element, etc., contrasted, as in status or condition, with a surrounding element or group: pockets of resistance; a pocket of poverty in the central city.

Sorry for the freakin long boring comment

It's a beautiful shirt and I truly hope it makes it. I swear, unless you really enjoy shirts with bears, zombies, and overall ridiculous creatures on them, woot generally isn't the place for you -- or in this case, me.

Hopefully you can bring more shirt designs that people can actually wear without trying to be funny or outrageous. I hope to see more derby entries from you!

Flowers and their growth in Spring
Tired bears waking up
Melted snowmen
Greenmen
Butterflies
Flowers where their stems are springs
and
Scared snowmen

All of these topics I listed have more than one shirt with the same elements. It's the details that set them all apart and make them individual.
Worse yet, if one of the tired bears waking up places higher than the other, does that mean the other one will get rejected? Or will both be printed?

Is your piece focused on the mortality of snowmen and their fear of it?
Is the earlier printed shirt focused on the mortality of snowmen and their fear of it?
Are any of the shrirts you listed based on the mortality of snowmen and their fear of it?

It's a specific theme, that has been printed by woot. We aren't discussing two entries having similar content in one derby, or generic "themeless" shirts like flowers, trees, butterflies, etc, we are talking about a current shirt, a previously printed shirt by woot, and a very similar theme.

Sorry, but I feel it is important to break it down into this specific case, because studying multiple cases convoludes the whole discussion. The "but all my friends are doing it" argument just doesn't hold enough water in the legal or business worlds to me.

It's probably supposed to be Grass Green...which is a shirt color Woot uses, just not very often.

Some Grass tees:

http://shirt.woot.com/Friends.aspx?k=4602

This shirt does look brighter, especially since it doesn't look like an official Woot shirt comp, but I'm sure Woot would use Grass if it got printed.

So its because of a specific theme... So woot can never have a Spring themed derby again? or this winter we can not have a winter themed shirt? or Lets say this christmas woot can not print a christmas themed shirt cause last christams we got a woot shirt that was specific to christmas?

Well there is always next year....

Heaven forbid there be multiple scopes of the word "theme"? A very specific shirt theme being rejected, like say "Flying Penguins" or "Snowmen fearful of death", to be so blown out of proportion to apply to "flowers", "winter", "spring", or "xmas" is very sound and reasonable. Thanks for your input, it is plenty to make me not respond on the topic again.
