Nope.
It is blatantly obvious that the text in this design took 5 seconds to make versus the several hours I put into drawing/coloring/rendering the alien, which is the FOCAL POINT. The text only compliments the design. It is not the main idea. Tgentry would calls this "plussing". If you haven't read his help thread, you should. I recommend it to everyone as a starting point.

My vision for this shirt was that the person wearing the shirt could use it as a "conversation starter" (<--- hehe) at a halloween party/celebration. The joke was supposed to be the fact that the alien is the life of the party - drink in hand, telling stories and what not.

I'm pleasantly surprised to find this in the fog! I thought this derby would not be that great, but now there are two in the fog that I feel like I can't live without. Nice Job! The text is hilarious. I also wish the alien had a cigarette in his other hand, but I'm sure he's probably a health nut.

A speech bubble is hardly incidental..
just looking at the rejected items that say "not incidental text".. they are far less important to the shirts theme than this one..
take away the text and its a chestburster with a teacup, which makes no sense.. take away the teacup, and its just like two other shirts that were submitted.
Im not trying to knock the OPs effort.. Im just getting a bit put off by the application of woots rules each week.

Incidental text means the shirt would get the same point across without the text AND that it's not a major design element. It appears that woot didn't think you met these criteria.

Thanks, but It would be pointless this late in the game. If woot had rejected it early enough for me to still have a shot, then I would, but apparently they like smashing people's dreams of winning t-shirt contests, as well as, screwing them over by not giving them a fair amount of time to resubmit.
There really should be a time limit for how long after submission a design can still be rejected.

Actually, before rejecting something from the fog, the rejectionator calls a meeting of the woot staff. Since your design fogged over the weekend, they couldn't hold a meeting until Monday.

I don't think it's irrelevant at any point. I thought it was something you should know before you start accusing woot of "screwing you over". In fact, they have a judicious process in place to deal with fogged entries. At least they got to it on Monday. Other entries have been rejected from the fog as late as Tuesday afternoon and with much more controversial rejection reasons.

David, I think you're a talented designer, and it's admirable that you want to win badly. But attempting to threaten Woot? I'm not sure what you're trying to accomplish there. I hope you can come back and realize it's not personal when you're rejected, be it due to non-incidental text or not quite enough votes.

If you read the rules for the Derby you pointed to, they're slightly different than just "no incidental text" ...
incidental text is allowed as part of an illustration, but no slogan shirts

Incidental text only. A nametag or logo is fine as one element of a larger design. "This Shirt Is My Pirate Costume" is not.

I'm very frugal (and just had a baby, so medical bills and diapers - yipes!) and therefore haven't found a woot shirt that I liked enough to even spend $10 yet (and there have been plenty of awesome ones) but this one I would've bought no questions asked.

hmmm......I'm not a designer, so I don't pretend to know about these things......but it would seem to me that if woot rejects the design, that they would also be rejecting the rights to that design.
I understand a contract is signed beforehand, so that's not reality. Just too bad for the artist.
