I had a minor meltdown over my rejection last night... sigh.... then I woke up this morning, looked up Dr Who copyright information, and took the offending Dalek off,, reshaped the rock (thought the other was too big) and re-subbed.

The Police Public call box is public domain.

Everything else on the shirt is stick figures.

What's a good way for the uninitiated to get into Doctor Who? I wouldn't even know where to begin. It's like this gigantic story that's been going on since the 60's right? How would someone approach that?

There really is no right or wrong way to get into Doctor Who. For the most part each episode is it's own story (with the exception of the 11th Doctor and some minor references here or there.) As for older dvds, they contain their full story arcs.

Personally I came in with the relaunch in 2005's "series 1" which is probably the easiest place to start. In between "series 4" and the specials, I caught up on the older stuff. If you end up liking David Tennant (10th Doctor) as much as what seems like the majority of the fanbase, I'd recommend checking out the 4th Doctor (Tom Baker) next and moving up from there.

Can't really comment on 1st through 3rd incarnations of The Doctor though. Yet. Seems like they may be a bit too slow paced for my taste, imo.

Season 5 of the new series had a really good season-long arc, that's going to lead into the next series, so I wouldn't just take it as a one-by-one sorta experience. Personally I'd recommend that people go back to the beginning of the reboot with 2005's series and start there. The quality gap between this last series and the previous four is immense though. Doctor Who really upped his game last year.

Moffat ftw.

This version of the shirt is much nicer looking anyway. Good stuff

Definitely! Dr. Who is amazing, I actually got some of my friends in the dorm to start watching it, and they just love it! It's a great way to bond if you have a group, and it's an even better way to reach out to a community of already established geeks if you're looking for friends

And the Doctor would have a bow tie because bow ties are cool.

After one of my friends showed me a few random episodes (which was actually pretty confusing to me, and I don't recommend it), I started watching from the beginning of the new Series 1 (and reading Wikipedia when extra information was needed), and that's worked out pretty well so far. In the new Series 1, they assume that there are a lot of people watching who have little to no knowledge of the originals, so they do a good job of explaining everything. The only unexplained references are usually to things that are kind of elaborated on throughout the rest of the season. And anything that doesn't make sense, you can look up on Wikipedia.

Anyway, I love the shirt, although it would have been better if the Dalek could have stayed.

This gets rejected but the much more obvious Calvin and Hobbes shirt doesn't? Can't really understand that. This is primitive stick figures running for a telephone booth. The other is obviously Calvin and Hobbes, not drawn in a primitive style at all, darn near looking like the originals. I can't understand the reasoning behind this. The Calvin and Hobbes shirt is 100 times more likely to get you in trouble because it's so clearly those two characters. This is stick figures and a phone booth.

I don't understand why can't you run this woot? It's people running for a blue box. That could be anything, not necessarily a reference. Also, it's totally parody, because this would NEVER happen on Doctor Who. Plus, who cares if someone else did the work to create this stuff, other people should be able to profit off it! Gosh, it's just a teeshirt, woot.

Graffd02 would have to contact woot and say something along the lines of, "Hey...I REALLY want to "fix" this shirt and get it back in the derby. But I'm kind'of having trouble "fixing" it, when I don't really know what's wrong with it, since shirt.woot's reason for rejecting was along the lines of, "Rejected = 'cause we don't think it'll work." (In other words, no reason given.) So could you guys kind'of throw me a bone here, and tell me specifically what's wrong with it, so I can fix it? Thanks."

Oh...and like others, I'm still waiting to hear the reason woot's not rejecting the Calvin and Hobbs shirt...

The problem will possibly be that the BBC have owned the trademark to the TARDIS since the 90's. Even the Met Police in the UK (largest owner of real blue police boxes) were unable to overturn that ruling.

As for why the previous shirt got through? Well, it could be a simple as that was the one the caused a previously unknowing Woot to get a call from the BBC and have to agree to 'not do it again' or pay a royalty on each shirt. Or both.

Shame though.

the police boxes hadn't been used in many years and the beeb copyrighted it and the courts agreed that people associated the boxes with Dr Who rather than the police like they used to.
the boxes were phased out in the 70's, so the only one people really see nowadays is the TARDIS.

Have none of you thought that maybe they just don't want TWO Doctor Who related shirts at once? Two is a much bigger liability than one.

Given woot's history, I personally find that way more likely than them having any sense of copyright ethics.

I had, but given that they just said, essentially "sorry, no" without giving a reason, it's hard to tell. If they had bothered to say "too similar to a shirt we sell" I'd disagree, but at least find that to be an acceptable, within the rules reason. And at least somewhat consistent with their bizarre 'similar shirts' rejections in the recent past (which is to say, inconsistent). Generally one finds the "no, we can't run this" on things where woot is feeling like the copyright is gonna bite them in the ass, not enough parody, etc. (in my experience here leastwise).

Which makes a certain fogged design rankle more. Unfortunately, there's precedence for it staying up there. Even if it's over 3 years old - Calvinball in Derby 6.

That still doesn't make sense to me. In the past, when woot feels that it's got more shirts based around one subject than it wants to sell, they solve that by making it a rule in the next derby: "No mario" "No Star Wars" "No bunnies"

Woot's never (to my knowledge) had a rule of "No Doctor Who" or "No British shows" And there isn't a "No Television" rule here now either.

Also, remember that Woot exists to turn a profit. If they have one DW design that's stuck in the recokoning for more than a year, they should guess that another DW design would do well for them also. The fact that the resub fogged very quickly should re-enforce that to them. With the Dalek gone this doesn't break any copyrights. If the tardis shape was copyrighted or tradmarked, the "It came out of nowhere" shirt wouldn't still be available to buy.

It isn't reasonable to me for Woot to have rejected that kind of potential just because "We don't want to have two shirts about the same show."

I agree that Graff should e-mail and ask what the real reason is. Stress that you want to know so you can avoid making the same mistake in the future.

ARRRGG! Yes , Agreed, Woot is here to turn a profit. Not that I am anything to do with woot.

My fault... I'm not being clear. Yes, based on the votes turned in for this shirt Woot would turn a hefty income on it. Dollars! Woot is a commercial enterprise. They would have no problem with having 2 shirts of a similar design if each made them a good profit. They LIKE dollars.

Facts:

1)This shirt has polled exceptionally well.
2)The BBC owns the trademark that is featured on this shirt
3)Woot is here to make a profit

My extrapolation of these facts

1) This shirt would SELL well, and as Woot is here to make a profit then any reason that would stop them marketing it would be around COST, not SALES. (Woot wants to keep their dollars - like me)

2)COST, amongst other things, can consist of production cost (royalties) or contingent liability (Getting your ass potentially litigated).

My initial reaction

1)The BBC owns the rights to the TARDIS image worldwide and no matter how many times people state 'if they did, then Woot would not have done the "came out of nowhere" shirt.'... They do.

2) Graffd02 should be emailing the BBC *NOW* with how well this design has poled. There's little chance of it getting on woot because it seems they don't feel they can print the trademarked image...

... I want the shirt and I'd order it from the BBC ... or woot if the BBC tell 'em ok.

The old Enquirer wasn't a celeb rag many years ago...was blood, gore, decapitated burned corpses (no, not kidding, still remember that one from when I was in grade school!) and the like. Stuff we'd be unlikely to get to see in print these days.

But seriously this is like the 4th time I've made it to the fog and the 3rd time I've been rejected... I'm beginning to think it's that they don't like ME.

I imagine it's frustrating, sure, but if you come up with you own ideas you wouldn't have to worry about tripping up intellectual copyrights.

The Police Public call box is public domain.

Everything else on the shirt is stick figures.

Big Blue Box (series 2)
4 colors on Alsphalt

I don't see how It Came Out of Nowhere works but this doesn't...would have really liked to own this. ):

Sorry you got rejected, but you might want to contact teefury when your hold is up - they seemingly have no problems with copyright issues and you'd get your design back when they were done. I'd say RIPT too, but they just printed http://riptapparel.com/shirt/09/16/2010/whosicle

Yeah, I agree. Came out of nowhere wasn't even stylized and clearly said Police Public Call Box

Though it is true that the Police Box isn't public domain. It's copyrighted by BBC.

While your first sentence is partially correct, your second is wrong. A generic "Police box" CANNOT be COPYRIGHTED by the BBC. Why? Because they existed prior to the BBC using them. However, a specific instance of a police box (with a specific design variation) could be copyrighted, as that would be new.

It's like the Disney movies based on public domain stories: the stories weren't removed from the public domain just because Disney based films on them; only the specific likenesses and audio and new dialog have protection.

On the other hand, the term "TARDIS" and its likenesses are TRADEMARKs of the BBC.
