The issue here will lie with Etch a Sketch (or Ohio Toys) and not to do with similar shirts or it being off topic. At this point, I see no reason this wouldn't violate their copyright.

Etch on me.

I thought I'd do more of a costume shirt that you could wear any time of year rather than something strictly halloween that would sit in the closet collecting moths for 51 weeks.

A) reminds me of the Game Boy shirt a couple years ago. B) off-topic. This has nothing to do with Halloween. Instead, it's a shirt costume.

Fair. Scratch my first criticism. I didn't see that part. Woot did a costume derby once so I thought it would be separate. My second comment stands.

The rule has always been "similar shirts exist", not identical. However, it's woot's call. They've rejected less similar things in the past. They've also allowed fiascoes like what transpired in last year's derby/

c'mon man, you were in the pre-derby thread making comments on other people's stuff, so why didn't you post your idea? any number of regulars would have told you then that similar shirts exist. could've saved you a good 15 minutes.

You second comment about it being like the Game Boy shirt? I actually own that shirt, and it isn't similar enough to warrant the hammer. I think this is a unique presentation of the Etch-a-Sketch t-shirt and should stay. I'd buy one.

Banned due to copyright? I don't see how this box with two circles is infringing on copyright any more than the Game Boy shirt that was previously produced. Very disappointing. I was looking forward to wearing this one.

Given the gameboy shirt, and even today's shirt, I find this rejection to be wholly unfair.

If I were to include a logo with a different name than etch-a-sketch would that be ok? Or would I get nailed for text? This is only my third derby and I was excited to see it fogged.

I've been around woot long enough to know how it works. I'm just not artistically able to submit very often. Rejections are never across the board and fair. I get that. I can now see first hand what it feels like to be slighted. Even if I do have an idea that I can actually execute, I'm a lot less likely to put forth the effort, and I'm sure I'm not the only one.

Rule of thumb: If it looks like copyrighted / trademarked / registered property, expect rejection unless there is parody, which again is subjective, so could still lead to rejction for one but not for another. No easy answer, other than to say the best thing you can do is create new, original art that doesn't rely on commonly known items / people / comics / etc.

Additionally, I have no idea how the gameboy one came to print.

The shape of the shirt (and therefore the placement of the images on it) changes significantly depending on the shape(s) underneath it.
